Justice Ayesha A Malik was nominated to be appointed as the judge of The Supreme Court by Chief Justice of Pakistan (CJP) Gulzar Ahmed earlier in August this year. Despite her credibility, the lawyer representing bodies across the country had carried out a vigorous protest against the elevation of Justice Ayesha Malik to the Supreme Court.
According to the lawyers, it was against the seniority principle as Justice Ayesha is fourth on the seniority list. On September 9, the Pakistan Bar Council and other lawyers’ unions across the country had gathered in masses at a convention in front of the Supreme Court where CJP had to decide on the elevation of Justice Ayesha.
Justice Ayesha Malik of the Lahore High Court (LHC) was not selected as Supreme Court (SC) Judge as Judicial Commission (JC) meeting couldn’t concur on her name. According to subtleties, the legal commission meeting finished up uncertainly as the vote finished in a tie. Four votes were projected for Justice Ayesha Malik’s arrangement as a Supreme Court Judge.
Chief Justice of Pakistan Gulzar Ahmed, Justice Umar Ata Bandial, Law Minister, and Attorney General cast a ballot in her favor. While Justice Maqbool Baqir, Justice Sardar Tariq Masood, Justice (retd) Dost Muhammad Khan, and Pakistan Bar Council delegate Akhtar Hussain cast a ballot against her arrangement. However, Justice Qazi Faez Isa couldn’t go to the gathering as he was out of the country.
Malika Bukhari, a member of the National Assembly, and Maria Memon, a renowned journalist took to Twitter and expressed resentment over the failure of the judicial system to let the meritorious and deserving person get a deserving position.
Maleeka Bokhari tweeted that “Today is a Black day for Pakistan as the Judicial Commission failed to elect our first woman SC Judge.”
Maria Memon tweeted it is “disappointing” that the elevation of Ayesha Malik did not get approved by the Judicial Commisson of Pakistan.
Other people have taken to Twitter to express their disappointment with the cancellation of the elevation of Ayesha Malik.
